Terms and conditions
These terms and conditions (“Terms”, “Agreement”) are an agreement between murbit GmbH (“murbit GmbH”, „murbit“, “us”, “we” or “our”) and you (“User”, “you” or “your”). This Agreement sets forth the general terms and conditions of your use of the Drink Water mobile application and any of its products or services (collectively, “Mobile Application”, „App“ or “Services”).
Scope of License
We grant you a limited, non-exclusive, revocable and non-transferable license to use our mobile application. You are only allowed to use our App on iPhone, iPod Touch, iPad or other Apple device that you own or control and as permitted by the Apple Appstore Terms of Service.
Maintenance and Support
murbit does not guarantee any other maintenance and support as required by applicable law. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Licensed Application.
Warranty
Our app is provided without any warranty. This includes typographical Errors, inaccuracies or omissions that may relate to product descriptions, pricing, availability, promotions and offers. We reserve the right, top forrect any errors, inaccuracies or omissions, and to change or update information at any time without prior notice.
We and our partners, licensors, affiliates make no warranty that
- Our apps will be error free.
- The data provided is accurate and current.
- The services and features subject to charge will fulfil the user‘s expectations of quality.
- Any errors in our app will be fixed.
Liability
You agree that neither murbit or any other involved party is liable for any damages connected with the misuse of our App or any delay or inability to use our App. You further agree, that murbit is not providing any medical advice via its App. Content and information provided including text, photos, audio or video or other types of content does not replace a professional medical consultation. You confirm, that you are solely responsible for your health.

Intellectual Property Rights
The content displayed in our App is protected by applicable copyright laws and international conventions. Our logos and icons as well es marks identifying murbit or our Apps may not be used without our explicit permission. You are not allowed to reverse engineer, decompile, alter, modify or disassemble source code from our service.
Costs
The basic use of Drink Water is available for free. Our Premium features are subject to payment. At places where subscription to Premium Services is required you will be expressively be pointed to this fact.
Purchases, subscriptions and payments can be made directly in our Mobile Application and are facilitated by the payment procedures of the Apple App Store. All Prices displayed are subject to include taxes and fees calculated by applicable law.
In the event of any failure of the licensed application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the Licensed Applications.
Payment will be charged to your Apple ID account at the confirmation of purchase. Subscription automatically renews unless it is canceled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period. You can manage and cancel your subscriptions by going to your account settings on the App Store after purchase.
Legal Compliance
You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a „terrorist supporting“ country. You are not listed on any U.S. Government list of prohibited or restricted parties.
Links to other mobile applications
Although this Mobile Application may be linked to other mobile applications, we are not, directly or indirectly, implying any approval, association, sponsorship, endorsement, or affiliation with any linked mobile application, unless specifically stated herein. We are not responsible for examining or evaluating, and we do not warrant the offerings of, any businesses or individuals or the content of their mobile applications. We do not assume any responsibility or liability for the actions, products, services, and content of any other third-parties. You should carefully review the legal statements and other conditions of use of any mobile application which you access through a link from this Mobile Application. Your linking to any other off-site mobile applications is at your own risk.
Advertisements
During use of the Mobile Application, you may enter into correspondence with or participate in promotions of advertisers or sponsors showing their goods or services through the Mobile Application. Any such activity, and any terms, conditions, warranties or representations associated with such activity, is solely between you and the applicable third-party. We shall have no liability, obligation or responsibility for any such correspondence, purchase or promotion between you and any such third-party.
Changes and amendments
We reserve the right to modify this Agreement or its policies relating to the Mobile Application or Services at any time, effective upon posting of an updated version of this Agreement in the Mobile Application. When we do, we will revise the updated date at the bottom of this page. Continued use of the Mobile Application after any such changes shall constitute your consent to such changes.
Acceptance of these terms
You acknowledge that you have read this Agreement and agree to all its terms and conditions. By using the Mobile Application or its Services you agree to be bound by this Agreement. If you do not agree to abide by the terms of this Agreement, you are not authorised to use or access the Mobile Application and its Services.

Final provisions
If certain aspects of this Terms and Conditions should become ineffective, other rules remain unaffected.
